Terms and Conditions

  1. Introduction
    1. We are Think Tank Communications (Pty) Ltd trading as iFINDTXT.
    2. You, the individual/company (The User) enter into this agreement with us.
  2. The service we provide
    1. We allow you to send and receive text messages to other registered users from your mobile device via the Internet.
  3. What we shall do for all Users
    1. Allow access to your data from your mobile device protected by Username and Password.
    2. Allow access to your data from a WML client protected by Username and Password.
  4. What you must do
    1. Keep your username and password confidential.
    2. Ensure that your handset is compatible with our service.
    3. Get your friends to register before you can send to and receive from them.
  5. How we protect your information
    1. By means of a secure server.
    2. We will not sell, trade or rent your personal information.
    3. We are committed to protecting your privacy.
    4. We may be required by law to provide information about your telecommunications traffic to the relevant authorities.
    5. We cannot eliminate the possibility of unauthorized access to the contents.
  6. Property
    1. All communication media and systems including content infrastructure and software associated with us remain our property. By using our service you do not obtain any rights to them and agree you will not do anything or initiate anything to be done that will affect our rights or our use or that of others lawfully using the same.
  7. Limits on our liability
    1. Access to the internet, the mobile networks and other communication media is associated with risks concerning authentication, data security, privacy, availability of services, reliability of transmission etc. and you agree to bear full and exclusive responsibility arising from such risks and consequences of the use of our services.
    2. We are not liable for damages resulting from the loss of any delayed delivery or non-delivery of messages.
    3. We endeavor to provide a server- based service 24 hours a day 7 days a week, we shall not be liable for the downtime of mobile network provider services or of our own servers.
    4. We make no representations or warranties (express, implied and statutory, including but not limited to the warranties of merchantability and fitness for a particular purpose, and non-infringement of property rights) as to the services and all information, products and other content (including third party information, products and content) included in or accessible from our website.
    5. Neither we nor our affiliates or content providers shall be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute services arising out of or related to the use, inability to use, unauthorized use, performance or non-performance of the services even if we have been advised previously of the possibility of such damages and whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise.
  8. Fault reporting
    1. We shall accept fault reports by email to support@revotxt.co.za. Faults cannot be repaired if circumstances beyond our control prevent their repair. We shall use reasonable endeavors to ensure uptime of the service.
  9. Technical alterations
    1. We reserve the right at any time to carry out technical alterations to our equipment.
  10. Rewards programme
    1. We reserve the right to alter or discontinue the incentive scheme at our discretion and without prior notice.
    2. Any reward or voucher has no redeemable monetary value.
  11. Misuse
    1. Should you be in breach of any term of our agreement with you we reserve the right to cease providing the service without notice or compensation without prejudice to any other claim we might have or remedy we might pursue.
  12. Notices
    1. Service of all notices shall be at our registered office, which is at P.O. Box 1426, Cresta, 2118, South Africa.
  13. Claims
    1. Any claims must be notified to us in writing to arrive within 28 days of your having sufficient information to know that a claim might arise.
  14. Intellectual property rights
    1. In using our service you warrant that you are not in breach of any other party's intellectual property rights and undertake to compensate us for any losses claims and demands that may be made by any party who claims that his rights have been breached.
  15. Jurisdiction
    1. This contract is governed by the Laws of the Republic of South Africa.
  16. Interpretation
    1. You must at all times comply with all applicable laws, regulations and restrictions.
